On March 22, 2020, Governor John Carney issued Fourth and Fifth Modifications to his Declaration of State Emergency, ordering “non-essential” businesses to close and all state residents to “shelter at home” except to engage in essential activities or essential travel. The Governor provided an extensive list of essential and non-essential businesses and FAQs.
On March 22, 2020, the Supreme Court of Delaware issued Administrative Order No. 3 declaring: “Statutes of limitations and statutes of repose that would otherwise expire during the period between March 23, 2020 and April 15, 2020 are hereby extended through April 21, 2020. Deadlines, statutes of limitations, and statutes of repose that are not set to expire between March 23, 2020 and April 15, 2020 are not extended or tolled by this order.”
