Stay-at-Home Order; Debt Collection an Essential Business

On March 23, 2020, Governor Jim Justice issued an Executive Order requiring all individuals within the state to stay home unless performing an essential activity, as defined in the order. The Order also mandates the closure of all “non-essential” businesses. Professional debt collectors are included in the definition of essential business.


On April 3, 2020, the Supreme Court of West Virginia issued an Amended Administrative Order regarding its previous declaration of a judicial emergency stating, in part: “Statutes of limitations and statutes of repose that would otherwise expire during the period between March 23, 202, and May 1, 2020, are hereby extended to May 4, 2020.”
