Guidance Advising Debt Collectors to Refrain from Telephone Calls
The Wisconson Department of Financial Institutions issued guidance on April 13, 2020 advising that due to the COVID-19 pandemic, customary debt collection practices could be viewed as violating Wis. Stat. § 427.104(1)(h) prohibiting harassment. Wisconsin’s debt collection law applies to both creditors and third-party debt collectors. A copy of the guidance is available here.
On March 24, 2020, the Wisconsin Department of Health Services issued an Emergency Order requiring all individuals present in Wisconsin “to stay at home or at their place of residence,” with the exception of 1) Essential Activities; 2) Essential Government Functions; 3) Essential Businesses and Operations; 4) Minimum Basic Operations; 5) Essential Travel; and Special Situations, all of which are defined in the order. The Order is in effect from March 25 through April 24, 2020, subject to any subsequent order.
